I have C&F interview coming up. I have two prior arrests for DWI. Both were plea bargained down to a DWAI - driving with ability impaired - which are "traffic infractions" in new York - not a crime. therefore, if I am ever asked if I was convicted of a crime the answer is no; but if ever arrested the answer is yes.
How do you think this will effect my ability to pass the C&F portion of the interview? I called a lawyer who handles this and they want $200 for a consultation fee (but said they wouldn't come to the interview, b/c that is "weird"). Is it worth paying this? Is it necessary?

Get an attorney friend. Don't try to play lawyer by saying that you never really got a dwi and etc etc. Get an attorney and let them handle this.

Pretty sure that the only thing that would keep you from passing C&F is lying about committing a crime, not actually having committed it (unless it's a super srs character-flaw crime, i.e. identity theft). If they ask you if you were convicted of a crime, you shouldn't say, "No," you should say, "No, but I was arrested for . . . "
A pair of DWI arrests isn't enough to keep someone from passing, so just be transparent. (Caveat: This is entirely based on what I've heard/read; I don't have any inside information.)

I'd talk to the lawyer. The C&F interview is usually a brief formality and it would certainly be weird to bring a lawyer to it, but for $200 you can get some peace of mind about what you can expect.
