DUI Summer before 3L?
I have a friend who got busted for a DUI this past (2L) summer and will plead to the DUI in January. How screwed is this person in terms of C&F? Anyone know of a person who got held up in their bar application for something so dumb. Is this that bad? Is this something they will just bring the person in and talk to about or is this something that will really have the ability to keep them from passing the bar.
Any real advice appreciated. I know this is bad so I don't need to hear how stupid this person is but rather from people who know others that have been in the same or similar situations.
Also, this really is a "friend" and not like my friend who has an eating disorder. So making fun is fine, I suppose but I feel *slightly* responsible for the outcome so I'm trying to do anything to help. Thanks!

is she pleading to a misdemeanor? b/c some states have a DWAI which is a traffic infraction. DWAI = dont worry about it.

Yes, it's a misdemeanor. Originally charged with agg dui for failing to submit to a breathalyzer but will plead to a misdemeanor dui. I'm not sure why the DWAI is but I don't think we have that in our state. But you don't think a misdemeanor would be anything to worry about in the bar application?Anonymous User wrote:is she pleading to a misdemeanor? b/c some states have a DWAI which is a traffic infraction. your friend should probably get advice from a lawyer familiar with C&F issues instead of randos on tls

I agree. I go to a T14 and we get semesterly emails from our ethics counselor who will actually help you write your C&F section to be truthful and not get you dinged. My friend at a T4 reports having the exact same service made available, so your friend's school must have someone like this in the dean of students' or registrar's or career services' office.Anonymous User wrote:your friend should probably get advice from a lawyer familiar with C&F issues instead of randos on tls

What his BAC? If it's a little over the limit, maybe not so bad. If he was driving shitfaced, might be a problem. Refusing a breathalyzer also doesn't sound very good--sounds like he knew he was drunk and was trying to get away with it, which will also be frowned upon.

This. They should go to their dean of students and say they need legal advice on a potential C&F issue. The school should help him out; after all, it's in their best interest to keep their graduates' bar passage rate high.Anonymous User wrote:your friend should probably get advice from a lawyer familiar with C&F issues instead of randos on tls

the internet is not the place to get advice on C&F issues.

Re: DUI Summer before 3L?
OP here:
I love all the cute baby lawyers using their law school education to tell me to talk to an attorney. Well, obviously. My friend has already talked to an attorney and the Dean so that base is covered. I was trying to determine if anyone knew of a law student who was still admitted to the bar after this kind of problem. The Dean and the attorney do NOT know how the Board will view this type of thing. All they can really say is "oh well this will bring attention and may or may not cause you to be held back".
So again, anyone with personal experience in this area? I've had enough "legal advice" from the law students.

Being a dick behind an anonymous post is not the best way to get help. If you don't want help from law students, it might be best not to post on a website called "top law schools."
I also think it's cute how you think that anecdotal evidence of one guy who did or did not pass the bar with some vaguely similar circumstance as your "friend" will give you any more certainty about your "friend"'s chances of passing the bar than what the Dean and a C&F attorney have told you.. er, I mean, told your "friend."

Stunning that the prick who got a DUI right before 3L doesn't show the discretion to not be a dickhead, and maybe, just maybe, ignore the posts that he doesn't like in the hopes that someone will answer his actual original post.
Just fuckin around. I'm not surprised at all.
And no, I don't know anybody who has cruised on through C&F after a DUI before 3L.

Do people get through C&F with DUI convictions? Yes.Anonymous User wrote:OP here:

Will your "friend"? Who knows.
What else do you want us to tell you -- a bar examiner from your jurisdiction is not going to log in and give you a ruling on TLS.

Re: DUI Summer before 3L?
I just find it hard to imagine that One incident, even in law school, would preclude you from taking the bar (or your friend, or anyone). As long as there wasn't some type of wreck involving another vehicle or other aggravating circumstances, I would think they would look past it unless you were not candid or simply fucked up the meeting. (at least, I am telling myself this for optimism/personal reasons).
If it was part of some kind of pattern however, there may be a problem. One attorney I spoke with said she had only denied a handful of applicants in 30 years, mostly domestic violence or something continued similar conduct. My attorney seemed to think it was okay saying they were normally looking for people who are "real fucked up" and would do a disservice to their clients and the profession. Another said "you should be okay...but don't get another".
Anyways, there's my own "you'll be fine" talk (for your friend and myself). I'd be glad to hear any anecdotes out there from personal or second hand knowledge.
