That'll happen. I also don't think it'll take long for a panel to disregard extrinsic "fact-finding" that the district court found dispositive; instead, a panel will just look to the intrinsic evidence and set aside the district court's claim construction based on de novo review. In other words, they won't even bother with factual review and the corresponding clear error standard. Then there will be more hand-wringing about the CAFC defying SCOTUS.

Unlike most of the other recent developments recounted ITT, Teva is actually good news for patent litigators. Claim construction will turn into a labor-intensive evidentiary hearing.

it's actually good because a lot of district court judges have basically just stopped putting any effort into claim construction because they mad about de novo review

as soon as I have $100K in my trading account and $50K in cash savings. i believe that is the minimum I'll need to sustain my current lifestyle by day trading.
