Quick question, i'm waiting on my retake score from Dec, I should wait to apply or go ahead and do it?

Well most admissions offices are closed until the beginning of the year, so they won't see your application until then anyways. I would advise you to use this time to edit your application and personal statement and send it at the beginning of the year.

Instead, you can prepare for the LSAT, finalize your application, and make any necessary revisions before submitting in January or early this the year.
