C&F question
I'm a rising 3L and have a question about character and fitness disclosures. I do not have a criminal record but a year ago while out at the bars I got separated from my friends and was apparently really wasted (I later realized I had residual antibiotics in my system that were reacting poorly with alcohol). A cop came up to me and was concerned. He then dropped me off at a treatment facility as per the police department policy when an officer is concerned about someone's level of intoxication, but is not breaking any laws. I was not arrested and these kinds of transports, again as a matter of policy, are prohibited from being taken down as an arrest.
I feel I should disclose this incident under the section of the C&F app that require disclosure if you've ever been compelled to undergo an alcohol/drug abuse assessment. Before I was released (which was a few hours after I was taken in-- they require you to stay until you're BAC is down to zero), I sat down with one of the specialists at the facility. After chatting with her for a few minutes she said that the incident seemed to be a one-time fluke, and did not refer me for further treatment.
Do you agree that I should report this incident? I planned on being really forthcoming, saying it was irresponsible of me and a mistake, and that I have been careful not to put myself in that sort of situation again (all of which is true). Thoughts about disclosing vs. not disclosing, and what an appropriate way to explain the incident would be?

Also, should I be nervous about my odds at passing C&F because of this incident? None of my references, employers, or supervisors will say that I have substance abuse issues that would inhibit my ability to practice law. After the incident I independently sought out meditation/stress management classes and have avoided any kind of heavy drinking. Should I mention that as well?

Things that the bar really cares about: lying, dishonesty, repeated issues, etc. I approach disclosure questions from the presumption that you should disclose unless you unequivocally do not have to. I don't think that what you went through probably was what the question was intended to cover (e.g., court ordered counseling), but since I can't say unequivocally that it isn't covered by the question, I would disclose.mmm123 wrote:Also, should I be nervous about my odds at passing C&F because of this incident? (Obviously not legal advice, i'm just stating that I would err on the side of disclosure. You have to make the decision yourself.)

Disclose. On the off chance it is discovered, you're more than likely going to have to explain it. You'll be a better position to explain it if they don't believe you were hiding anything vs. Explaining it, and the reason why you chose to hide this fact.

Yeah-- that was my thought too. While I know for certain it wasn't an arrest, I don't know if some other write up was made with my name on it that could be traced back to me. I'd hate to be caught hiding something. How much detail do you think I need to go into? The date, the facility, etc.? Or just generally explain the incident and how I responded?

Just a basic summary of what happened, how it ended, and what you learned from it. Note that you haven't done anything since of the sort, and you have grown beyond that. Spin it as a learning lesson.

As an alcoholic who quit drinking in Feb. 2013, I read this and it reminded me of all the times I told friends that something something reacted with the booze, and that's why I woke up passed out at 4am in a park. If you report one, can't they just look up and ban the user? I reported one but figured after that the mods got the idea.ilovesf wrote:report the posts
