Arrest Record/Expungement - Law School and Bar

Post by lawschools12345 » Thu Jan 21, 2010 7:19 am

What information should be released to the Law Schools and the Bar concering an arrest record that has been expunged? I have been arrested before, but the record is supposed to be completely expunged. How do I find out? I have a friend in the same situation that is also applying to law school. I know it differs from state to state, but the states in question in these two circumstances are : Ohio and South Carolina.

Any suggestions?

Most applications want to know regardless of if it was expunged. Do what it says or you're not going to be admitted to the bar in three years.

If you are lawyering your C&F disclosures, you're doing it wrong.

So, if the record is expunged, then you should still put it on your application? I thought you only had to list your expunged record on the bar and not when being admitted to a law school. I am a bit confused as to how this works. I know you are saying to tell them, but if its expunged why do they need to know?

The law school applications tell you what they want to know. Some just want to know convictions. Others want to know any arrest, regardless of dismissial, juvenile status, expungment or pardon.

They're not kidding when they take the second approach.

I gave EVERYTHING and you should too. It is very important to be brutally honest. I had a juvenile thing that was expunged ages and ages ago. It was really very silly but I absolutely included it in the apps that asked that question.

Just do what the app says. Most will tell you if they want expunged offenses.

My arrests, convictions, juvenile record, DUI, etc..... totaled 3 dense pages of embarrassment. Finding details on the expunged stuff as a kids was difficult. As a bonus, I got to explain arrests that I do not recall.

I chuckle when reading posts asking if they should disclose a "warning for violating a noise policy" at their dorm.

I found this very helpful: http://www.top-law-schools.com/forums/v ... 22&t=86526
