On [date], I was arrested for driving under the influence (DUI) of alcohol in [city,state]. My citation number is [no.]. In lieu of entering a plea, I agreed to enter into a diversion contract, in which upon completion of the contract, the charges will be dismissed with prejudice.

In summary, I have agreed to waive the following rights or agreed to the following claims: agree to the stipulation of the facts presented in the police reports and witness statements, agree to all terms and conditions as set forth by the court, agree to waive the right to waive my right to confront witnesses, agree to waive my right to a speedy trial, agree to waive my right to a trial by jury, agree that the diversion agreement will be terminated upon noncompliance, and agree to waive any claim of double jeopardy.

In summary, I have agreed to the following terms and conditions of the diversion agreement: I will be monitored by an agency, I will complete an agency recommended evaluation and treatment program at my own expense, I must pay a fine to the City of [city,state], I will be found guilty and imprisoned if the diversion agreement is revoked, my charges will be dismissed with prejudice upon completion of the diversion agreement on [date], I am voluntarily participating in the diversion agreement, I shall not consume or possess any alcoholic liquor or cereal malt beverage during the term of the agreement, I will not ingest or consume any illegal substance or drug, I will submit to drug and alcohol tests at any time at the whim of my monitoring agency, I will inform my monitoring agency of any arrests during the agreement, I shall maintain present employment or education, and If I am convicted for a violation of the law during the agreement then the diversion will be revoked.

I have completed all treatment and evaluation requirements as required of me by the monitoring agency. They have indicated through their evaluation that this arrest is not indicative of a larger substance abuse problem. I continue to check-in with them on a monthly basis and submit blood or urine samples at their request. I am not proud of this incident; I plan to learn from this incident and become a better person because of it.
