If you're unsure, disclose. If you really don't want to disclose, consult an attorney to ascertain whether or not you were actually charged and whether or not you were arrested. If you were not actually charged or arrested, you will only have to disclose on those applications that ask for criminal citations, which many do. In fact, I believe that most apps fall into two categories: (1) those that ask for the kitchen sink, including citations, arrests, charges, etc. and (2) those that ask only for convictions, which is the minority of top schools. It would seem you will have to disclose on the former but not the latter, but again you must err on the side of disclosure.
