I have done 3 Penn performance test via Kaplan and for some reason I miss the pass mark by one point every time...I'm wondering if they grade these essays more harsh than the actual test.
Like one grader docked me points because I didn't use the exact phrase of long arm statute even though I performed the test for it in the analysis.

if the law is written out for you and you want to analyze and apply the law, test graders may dock points if you don't copy the law exactly as written. Unlike other essays where you are only given the facts, essays that give you the law and the facts expect the law to be regurgitated exactly as written.
additionally, you should be copying all facts exactly as they are given in all of your essays. If its given to you, graders are going to want to see it regurgitated to them exactly as written
