Note atopic Advice

Need help figuring out a topic for my secondary journal (corporate/financial law) note. Would love to write something on Aereo or NCAA (O'Bannon) but I know they'll be popular topics and I have to pass the preemption check to get published. Any thoughts or advice to help narrow the scope?
