I have a 3.91 GPA from a top 25 uni. and pretty decent softs

Thanks. And I'm going to. However, are my chances going to be pretty shot if I apply to, let's say, Duke or UVA, that late? (this is saying that my score would be, hypothetically, around a 169-170)

Are you a URM? No shot with a 162. Softs distinguish between two people with nearly equal stats, not 3-4 point LSAT differences.

Edit: Definitely retake. The Dec test will release in Jan and make you pretty late in the cycle. Do it and apply, at worst you sit out a year which is the only other alternative because you're not getting in with a 162.

Yeah sorry I'm being confusing. Ok- not URM. I for sure know i have NO shot at those schools with that score. I'm just asking if I retake and do well, would I still have a decent shot even those it'll be early Jan.?
I'd hate to sit out a year/definitely dont want to

I'm still confused. If you have no shot now, and some shot if you retake, what's the question? It won't be as good of a shot as if you had the new score now, but some shot is better than no shot.

You'd at least have some shot with a retake. I have no way I quantifying the difference. Mate check out lawschoolnumbers.com and look at the applied dates.
