I'm surprised you consider that such a big reach. I guess maybe by reputation NYU favors the other side of the splitter continuum? Honestly with a GPA that high you should be in the running for some $$$ in the lower T14, and you have a good shot at NYU outright. I'm not sure ED is the prudent course. My two cents.

You have a pretty decent shot. Seem like a 50-50 shot for those who have an LSAT between 167-169 and 3.9+ GPA. Going back through each cycle, this seems pretty consistent. LSP also pins you at a 50% shot.
So there is absolutely no wiggle room in retaking? 4 more points will literally guarantee you CCN absent some major screwups in your apps

My numbers (3.87/169) and goals put me in a very similar boat. I'm thinking that we have a 60-70% chance with our ED. Good luck to you!

The WL-in votes are refreshing. Does NYU generally see some movement off the waitlist? I've heard that UVA WL is essentially a soft rejection.

OP, you should check out how similar numbers fared at MVPDBN. With that GPA, I think some $ there would be a real possibility.
Also, what about re-taking? I don't know if cancelled tests count towards the 3 tests in 2 years policy, btu I know that in any case, you can always appeal.
If you can hit 170 or anything above that, you are now talking good money at CCN and H will be in reach as well (y and S are never certain).
