I'm thinking your chances are very good even as an out-of-state resident; unless Texas averages LSATs, in which case I think you have a slim shot.

From what ive heard they look at the highest (not from tls profile, but from the dean of admissions here) as long as their is a substantial improvement (5 is iffy) and you have a reason. So happy bsing
