Because their medians are above 168/3.8.

Rule of thumb.

If you aren't a URM or have cancer curing softs and are below both medians you can expect a WL/Reject.

There could be a very large number of people at - 170 seems to be a magic number with Penn either way, if you look at anecdotal evidence.

Twenty five percent of students have a 166 or below...but these can also be accounted for with URMs and reverse splitters. A 3.8/168 doesn't have a great chance at Penn, although it's still definitely very possible, but a 3.9/168 has a better chance because they are, at the very least, above one median.
