Tax against Asians in elite law school admissions?

Post by Anonymous User » Mon Jul 04, 2022 12:39 pm

It's consensus in certain circles that there is a negative preference against Asians (both East Asian and South Asians I think) in elite college admissions: https://nymag.com/intelligencer/2022/02 ... sions.html.

To what extent is this true in elite law school admissions? If Asians aren't URM, then does that mean that they are viewed as equal to whites? Or are they actually worse off than whites?

URM status helps a lot. Everything else doesn't matter (although personal circumstances & diversity of perspective / experience can certainly help your chances if presented tastefully and thoughtfully).

Hard to tell. I don’t think there has been a clear study of lsat and gpa compared to background of applicant with the categories you are asking about.

It is a consensus among some poorly informed groups on the far right wing who seek to use it as a dividing driver, it isn't reflective of actual fact as borne out in court. If you had listened to either the UT or UNC/Harvard Affirmative Action cases, you'd have seen that the data showed higher scoring African Americans and latinos were rejected in favor of lower scoring Asians and caucasian students. It was in index 78 of SFFA materials, that the professor they hired actually found they rejected in the top decile of gpa/test score students, Blacks at the highest rate, followed by Latinos, Asians then caucasians. This was part of the reason both the district and appellate courts ruled against SFFA, who argued this unproven allegation.

It was also revealed that caucasian students get affirmative action and it is applied to only 1% of in-state students and 5% of out of state students. We don't actually know exactly what ethnicities are getting affirmative action as ratios but we do know that indeed many Asians are receiving affirmative action in college admissions. Professor Frank Wu was one such Asian and wrote about it in his book Yellow.

Affirmative action is very complex, it cannot be reduced to the headline that right wing rebel rouser shock jock media seeks to reduce it too. It is merely a factor, among factors of factors used to enhance the diversity of the classroom as the schools have a diversity interest.

In fact, there exists another consensus in other groups that the LARGEST beneficiaries of affirmative action are foreign Asian students as they get in with lower grades/test scores than everyone else and have a record of poor performance.

"1 in 4 Chinese students drop out of Ivy League Schools"
https://www.scmp.com/news/china-insider ... ue-schools

As they are not able to handle the rigorous academics of the programs as they are let in as Affirmative action admits without proper qualifications. The highest of any ethnic group, except Koreans, 44% of whom drop out, the highest of any ethnic/racial group.

"Forty-four percent of Korean students at top American universities give up their studies halfway through."

From Hernanday above.

Are we in a Reality Distortion Field?

If the above is true then we should see Black student groups suing Harvard and calling for an end to Affirmative Action, but we don't see that.

Also, after Prop 209 was enacted in Calif, ending aff action, minority enrollment in the UC system fell precipitously. How can that be reconciled with the above by Hernanday?
