Surface Pro for LSAT FLEX

Hello!
I am planning to take LSAT FLEX this coming June and wondering whether Surface Pro is allowed for the test.
It runs Windows, but some people might consider it a tablet.
I've read on Reddit that some were just able to take the test with it, but I do not want to take a risk since it is the only laptop I have access to as of now.
Also, is it okay to use a Surface pen for touch screen?
