LSAC GPA 4.02
LSAT Dec 2012 165
Non-URM

Solid extracurriculars, publications, etc.

I applied last cycle in mid. January - dinged from Harvard and Stanford. In at Berkeley, UChicago, WL Columbia, Penn, etc.

I spent one gap year doing nothing and this gap year I'm spending doing a legal fellowship.

I was supposed to take October but I haven't been studying. Should I just apply with the score I have? Should I apply and file by October and take the December test?

Your cycle will go much the same if you just apply again with the same stats. A little work experience is not going to make that big of a difference.

I'd take another year to work your job and hit June 2014. With a proper LSAT score, and with that GPA, you can have HYS/full rides to most of the T14. If you're set on this cycle, study for December. Good luck!
