I fully understand that some schools average your two scores, but I'm taking mine in two weeks for the first time, and applying to go to law school this cycle... Any apparent negatives for retaking in dec in case i dont hit 170? Also, what happens if you do retake it, but do worse?

Outside of the T6, almost no schools average and even the T6 does it on a case by case basis, though I would say the trend is moving away from averaging.
If you do retake it will make your application go complete at a later date and I would say that going complete late December/early January is a disadvantage. However, a 170+ going complete in January is better than a 170- going complete in October.
If you do worse, it will make almost no difference considering almost all schools take the highest score.
