Summons. Help Please :)

Hey,
I got a pink summons for walking in Central Park after 1:00 am. I had no idea it was prohibited.
They told me I had to go to court in 2 weeks. In how much trouble am I ? What should I do ?
I'm an international student. How will this affect my application ?

Look up the section being charged with (checked on the summons), if it is a misdemeanor or felony, then go see a lawyer.

Hahaha...yeah, I've heard they hand out jail sentences of more than one year for walking through Central Park after 1am.

As long as you weren't being disorderly or anything like that, you could prob get it dropped as long as your lawyer knows what he's doing.

Criminal Trespass is Felony 3 in PA. You don't know the circumstances.

You could be charged with disorderly for pretty much arguing with the cops.
BTW, I was charged with both Criminal Trespass and disorderly conduct for something very minor. Not guilty, but still had to write an addendum for it. Trust me, it was more minor than walking in a park after dark. And yes, they can charge you with a felony if you piss them off.

Apparently truth is stranger than fiction. Read my above post. Not only they charged me with it, they refuse to drop it. I had to go to court to be found not guilty.

That would suck for OP b/c if he does end up with a felony, law school shouldn't be his worry as much as deportation. But prob didn't do anything too bad as to lead to that.

This is besides the point, but if you are charged with non-violent crimes in overworked cities/departments a lot of times you are released on own recognizance. No bond, just a court date.

I just wonder what's there to do at in Central Park at 1am in January? But seriously check the code / statute you are charged with - it should be right there on the summons and look up the penalty for it and then you'll see if there is a reason to freak out.

I think you could probably get off with probation, but it depends on if there are any aggravating factors. Were you walking loudly? Talking on a cell phone? Walking in the grass? Smoking a cigarette? I could be wrong since I'm no expert on New York law, but I believe if any of these factors are present there is a mandatory jail term.

Actually, no, they can't, because cops don't charge people. DA's charge people.
