What did everyone think? I feel like Barbri makes their questions a lot harder than necessary.

I understand their reasoning but its annoying

Yeah there were definitely a lot of ticky-tack questions. I'm content with my 67.

I mean they say the average score is a 56. So anything above that i assume is fine.

Thought it was pretty difficult. Got annihilated on Con Law, when that had been my best subject throughout prep. Got a 55 :cry:

Youre all good. I think these were so much harder than any other question set we've had. lots of two checkmark questions :lol: :mrgreen:

You'll be fine. Finish out this last week strong and know these questions were meant to be a lot harder.

You'll be fine. Finish out this last week strong and know these questions were meant to be a lot harder.

If it makes you feel better I got a 52. And my simulated put me in the top 25% so I was like okay yay I'm not a total idiot!!
Now, not so much. And lol con law is my weakest, I now get more mortgage problems right than anything Congress related. It's so funny how we all have different strengths. :D

Can anyone confirm this quickly:

Original commercial lease is 5 years, T becomes hold over T. The new lease is not technically a "tenancy for the years" it's now a periodic tenancy but T is still held over for 1 more year right so it's now a "year to year tenancy"... I think I'm thrown off by the yearly term.

And if original commercial lease was for 9 months (so less than 1 year): and T is held over it goes month to month like a residential lease would?

Yes. At least that's my understanding as well. And in either case, if the T has notice of the rent increase before the lease is up the T will be held to the increase in rent.

Got a 62 and was in 25% for simulated; really glad to see I am not alone. I actually got sub 50% in Torts, which I hope was an anomaly. Did anybody else think that Civ Pro seemed a lot harder than normal as well? There was a venue question which made no sense to me - about corporate venue based on PJ. I am still scratching my head on the explanatory answer on that one (q54). Anybody else know what I am talking about / can explain?

A corporation is deemed to reside for venue purposes anywhere it can be sued. Thus, if the corporation has minimum contacts / purposeful availment, it is a resident of that venue. In this question, the defendants reside in the same state (which is different from SMJ domicile) Venue is accordingly appropriate in any venue where a defendant resides if all defendants reside in the same state.

Where was the average score stated? Is it based on historical performance, or continuously updating like the simulated MBE?

Edit: Never mind. I see it in the MPQ book.
