Bonus MBE question:

DwEEb posts to an internet message board for lawyers and law students about a frivolous claim for damages DwEEb plans to submit to a credit card company or the Federal Trade Commission, thinking that strength in numbers will somehow legitimize DwEEb's claim. Is DwEEb correct?

A. Yes, because the Federal Trade Commission has authority over all monetary disputes, regardless of whether they are frivolous.
B. Yes, because DwEEb's theory of damages is based in both law and fact, and DwEEb must be afforded due process.
C. No, because DwEEb must first submit the claim to the credit card company, and then gripe later when the credit card company denies the frivolous claim.
D. No, because DwEEb learns the message board he posts to and is a member of is full of "aspie loners" and "ultra-gunners."

I must be the only one that didn't have a problem at all uploading my exams.

Don't intend to derail what is already a "productive" thread by TLS standards, but aside from the screaming about lawsuits and class actions (and contrary to some posters in here, I do think it was a big deal that this happened...the bar exam gives even the most rational person the crazies, and I can't even imagine going through something like this during the actual exam), has there been any explanation/investigation into why this happened? Cause I sure as hell do not want a repeat when I take it next summer.

Not according to my credit card statement. I'm honestly thinking about calling American Express, explaining the situation, and requesting to dispute the transaction. At the very least, it's shady, and I don't think American Express wants to deal with shady merchants.
If you're "honestly thinking" about doing that, then I honestly question your actual intelligence, these are the people who will be processing your exam answers. Go ahead and try messing with them, just so that you can get a petty refund.

Whomever fails the bar could successfully hold Examsoft responsible. Granted they will have to show how they were damaged by Examsoft (given the circumstances, not a high bar).

20,000 exam takers paying $150 = $3M. Examsoft could easily see that figure vanish in a heartbeat. It should get interesting around September/October. I wonder what firm represents Examsoft? They are going to need to hire more lawyers!

If you failed the bar because Examsoft didn't upload your answers, sure. If Examsoft uploaded your answers and you failed, you're SOL. (If you're going to argue that you failed the bar because the stress not being able to timely upload your essays meant you choked on the MBE: just no.)

It really was not necessary for most exam takers to IMMEDIATELY try to upload their exams. Having used the internet once or twice, I figured that systems would be bogged down and never even considered uploading the first day. If your deadline was 26 hours away and you didn't need to hop on a plane immediately after the exam, you could have waited. I opened up my laptop Wednesday morning and it automatically uploaded in 2 seconds.

People can't reasonably believe that the board of examiners would just say "fuck it! no one gets to upload if you missed the deadline because the systems were down!"

If anyone has a story yet of a person whose exam will not get graded thanks to ExamSoft's screwup, I haven't heard it yet.
Hahahahahahahhah
You got called out on dorfonlaw.org for being an asshole.

"When failure is not an option" by Lisa McElroy and Katie Rose Guest Pryal, a unc law professor who specializes in mental health. Boom. I told you guys if you step out of this dumb hivemind you might realize that being a liberal alone isn't good enough to make you a nice person.

I don't really care about the $150 or the stress (you do realize that everyone experienced this stress equally, other than handwriters). I do hope a few states/scools drop ExamSoft for being so incompetent. How do you not prepare for a large volume of data when you know exactly how many people will be uploading at a given time? This is a "you had one job" kinda situation.

That's pretty much my sentiment too. " SUCK IT UP. DO YOU EVEN KNOW THE ELEMENTS OF NIED???" Like, get a hold of reality. That would fucking suck to not get to upload your exam.
