What's your dream essay breakdown for the CA Bar Exam?

Day 1: PT in the AM, to get it out of the way. PM essays: Evidence (non CA distinctions), Civil Procedure (non CA distinctions), Community Property
- These just ask for rote application of rules to the issues: good thing when brain fried.

Day 3 Essays: Contracts or Torts with Remedies cross over (you know they're going to ask a Remedies question anyway, better to not have it be a full question), Professional Responsibility with a touch of Agency/Partnership (again pretty easy rules on A/P and can get through Prof Resp, and they ALWAYS test it), Real Property - but an easy one like constructive eviction

If any of the following show up I'm going to be very unhappy/raged

Civ Pro - complicated CA q about general/special demurrers and the CA specific rules for timing of motions and a really complicated collateral estoppel issue
Con Law - F*** con law
Corporations - complicated Q about shareholder appraisal rights and the procedures to follow, complicated Q about ethical violations re Sarbanes Oxley, nuances of insider trading Q
Torts - surprisingly not a huge fan of defamation/Products liability/Stricts liability questions. Also questions asking about int'l torts and negligence are incredibly tedious to write out
Contracts - complicated formation questions
Evidence - tough CA distinctions
Remedies stand alone questions. F*** remedies

Hahaha, have you read my mind?

My dream is:

Evidence (federal or CA)
Con Law
Crim Law/Pro
Agency and Partnerships
Wills, Trusts, and Estates (maybe cuz I took it in school, I don't find it too bad)
Remedies (with easy Contracts, not the hard stuff)

I will die if there is Community Property. Or California Civ Pro.

The dream:

Federal Criminal Evidence
Crim Law/Pro
Torts - Intentional/Negligence
Civ Pro - Personal Jdx.
Con Law - anything first amendment


screw everything else.

Pure CA Civ Pro
Real Property with Fair Housing Act, Water Rights and Zoning/Exactions
Torts with Defamation and Privacy Torts. Some false light con law etc.
Corporation Question based on Fed Security Law
Conlaw/Community Property crossover on federal preemption of CA community prop law.
Professional Responsibility about sex, drugs, runners and cappers.

lol! Those are exactly the two subjects I just posted about on the themis board. I've let go of CA Civ Pro and Community Property. If they're on the exam, I'm doomed. I like your list. Although I'd probably swap out wills and trusts for Professional Responsibility :D Might feel better about wills and trusts when I review it later in the week...

I hate Con Law. I know it is supposed to be easier than most, but it is one that just seems to throw me every damn time.

In no particular order:

Real Property
Contracts
Torts
Wills/Trusts
Community Property
Straight Prof. Resp.

However I think it is very unlikely we get a straight PR essay, or a straight remedies essay. I would be alright with Evidence, so long as there isn't a heavy emphasis on CA distinctions. Would be fine in Crim as well.

I have it on good authority (my gut- it's a good size gut too) that we will get an agency/partnership essay too.... so I am prepping for that.

I really hope there is an agency/partnership question!

Ahh yeah, wondering if there will be a Con Law question involving Native Americans who have applied for citizenship or something while attempting to sell widgets interstate and conscripting their prison inmates, if any, to work in said widget factories without wages.

:shock:

My brain likes to F*** with me. Looking at that "positive visualization" and positive thinking advice is just making me panic more.

I took two bar exams, one that used the National MEE essays and the Cal Bar. The National MEE essays are very predictable. However, the Cal Bar is NOT. It almost seems like the Cal Bar examiners try their best to go against most of the predictions out there. All I can say is be ready to be surprised.

Oh my gosh, don't get me started on the MEE essays. I did one or two under Agency and Partnerships, since I guess California doesn't have enough of those for the Barbri practices. It was so much easier and radically different. I spent like a whole hour analyzing all these small points, and when I looked at Barbri's model answer, it just said, "Here, there was actual authority and apparent authority... the end!" The California essays are much more complicated and complex.

As for Professional Responsibility, I'm really nervous about it, because I can't remember the California distinctions. I can remember the ABA rules, but California throws me off because it says the opposite, with all sorts of qualifications.

Don't love agency/partnership, but I guess I could muddle through for an hour.

Dreading the possibility of:

When a subject is tested on Tuesday, it likely won't reappear on Thursday (unless it's remedies or something like that), right? Right???

As I'm reviewing remedies today and still can't completely articulate the difference between equitable liens and constructive trusts even though I kind of "get it" in my head convinced that there will for sure be a Remedies q tagged onto a torts or contracts essay and probably something really weird and horrible like a bailment situation. Or worse: a real property/remedies cross over :?

Look to see what the plaintiff wants- if they want the property back or the increased value of the property as well- Constructive Trust. If they can't get the property back or just want monetary relief- Equitable Lien.

If it's something like stocks that have appreciated in value, then you want the Con Trust so you can get the increased value. If it's something like money spent on a house or money put into a commingled bank account, you're stuck with the Lien and the property as security.

Con Law (everything but 1st Amendment which I'm still a little shaky on for rule statements)

Those are my 6. Not likely to happen but hey, it's call the dream for a reason. Also totally down for evidence, landlord/tenant, most of wills, and contracts that don't involve lots of 3rd party stuff.
