Didn't the tickets have a waiver of liability for your image being shown on television? Even if they didn't, isn't there a reasonable expectation if ESPN is broadcasting that you might be on an ESPN broadcast?

If I was opposing counsel, I would definitely take contention with the part of the complaint alleging Yankees-Red Sox is always the most popular game in ALL SPORT. That is just false.

Yoda speaks with better grammar.

Aside from the grammar aspect of the complaint, the fact the attorney thinks this is an actual case for litigation is ridiculous. This is the first I have seen, but going on the article (and everything on the internet is true, Lincoln said so himself) there is nothing there.

Duty - ?? don't humiliate dude on camera - seems like 12b(6) failure to state a claim.
Breach - ?? need the D to B her D.
Cause - possible if you buy the creative damages argument.
Damages - embarrassed. maybe they can get creative and say he's afraid of going to yankee games now, and that was his biggest passion in life. maybe his gf/bf left him bec. s/he now realized he is fat. money is sex, and sex is money so the court should award sex/money.

Upon a quick reading I missed the slash... thought it said sex money and got a little chuckle.
