Help me with the Nice Controlling Evidence

I am suing Johnson and Johnson for product liability. The drug Invega Sustenna caused permanent injury, tardive dyskinesia. The company says that mild symptoms of TD were recognized by the doctor in July 2010. They say Greenman v. Yuba does not apply. They applied the statute of limitations in California, two years. I say that the severe symptoms of TD, my involuntary eye tremors, did not begin until 2012.

Any thoughts on appeals arguments to the Ninth Circuit.?
