Undergraduate institutions often prefer to keep these situations "in-house" for PR reasons... Anyway I've said my piece.

I think he is saying that by disclosing the incident in your application to the da's office, you might end up giving the da more evidence than the police had at the time, so that the da might charge you with a crime.

I have no idea, but it would suck if it did, which is why you should talk with a defense lawyer. Applying would certainly bring your situation to the attention of the da's office, which is why you did some real legal advice about what is ok for you to admit to the da.

Ok. But what about the advice my university's director of public safety gave me? He ENCOURAGES me to apply....is that even credible? He has tons of experience working as a police officer....

He's not a lawyer, so he is not a source of legal advice about possible consequences of inadvertently incriminating yourself. He is more of a general character reference.

Nobody is saying that getting sanctioned at your school is going to lead to legal consequences by itself. However, when you describe what happened in your disclosure, there is a chance that you might describe or admit to actions that break the law in addition to the code of conduct. It's not the fact that you broke the code of conduct -- it's the actions themselves, and your description of them, which could create a problem.

It depends on the lawyer. Probably 50-150. This is something you can find out in advance by calling.
