Re: Internship with D.A 's office w/ disciplinary record
Undergraduate institutions often prefer to keep these situations "in-house" for PR reasons... Anyway I've said my piece.

I think he is saying that by disclosing the incident in your application to the da's office, you might end up giving the da more evidence than the police had at the time, so that the da might charge you with a crime.contrapositive1 wrote:I wish you could say more.Borhas wrote:Undergraduate institutions often prefer to keep these situations "in-house" for PR reasons... I have no idea, but it would suck if it did, which is why you should talk with a defense lawyer. Applying would certainly bring your situation to the attention of the da's office, which is why you did some real legal advice about what is ok for you to admit to the da.contrapositive1 wrote:Do you really think this could happen?Shmoopy wrote:

You're right. You should apply for it!contrapositive1 wrote:Ok. But what about the advice my university's director of public safety gave me? He ENCOURAGES me to apply....is that even credible? He's not a lawyer, so he is not a source of legal advice about possible consequences of inadvertently incriminating yourself. He is more of a general character reference.contrapositive1 wrote:

Nobody is saying that getting sanctioned at your school is going to lead to legal consequences by itself. However, when you describe what happened in your disclosure, there is a chance that you might describe or admit to actions that break the law in addition to the code of conduct. It's not the fact that you broke the code of conduct -- it's the actions themselves, and your description of them, which could create a problem.

I don't think it would be a good idea to apply without first discussing your disclosure statement with a lawyer, but all I really know is that it's better to be safe than sorry.

No - there is a chance you could be convicted based on new information.
No - please do not attempt to be a DA if you raped someone.

am I the only person who sees a problem with an admitted rapist wanting to be a prosecutor?
ETA: if you didn't have consent, it's rape regardless of what you choose to call it.

What DAs office are you looking to intern for? I'm surprised you didn't get in greater trouble, what school was it at?contrapositive1 wrote:So this is the deal. I was recommended to a position as an intern at the D.A's office (I will not say where) but I have a disciplinary record at my undergraduate school. I received 3 sanctions; the most grave was suspension from student housing (I will not say what school). This was three years ago, freshman year. I am now a junior.
What should I do? Should I even apply?
BTW the internship is unpaid, in a department that is understaffed

It depends on the lawyer. Probably 50-150. This is something you can find out in advance by calling.
Seriously? What are you waiting for?
