Judges Known to Have Fired Clerks

Post by Anonymous User » Mon Oct 31, 2022 2:31 pm

I know there are other threads describing best and worst judges to clerk for. But I want to start a specific thread for transparency purposes of judges specifically known to have let a clerk go or where clerks have left early from their clerkship. Hope this can provide important data points for future applicants.

I can start with two:
Judge Clay (Sixth Circuit)
Judge Berman (SDNY)

Interesting, I've not heard this one. Every Failla clerk I've spoken to has thought pretty highly of her, so I wonder what the circumstances were.

Rumors that Gujarati either fired her clerk or her clerk quit because the clerkship was so rough.

Someone was competent enough to get a federal clerkship yet dumb enough to be an anti-vaxxer? I'll bet good money that the clerk was a Fed Soc nut

Why are you making this post anonymously?

A sitting judge of New York State's highest court has held out as the only employee of the state judiciary to refuse compulsory vaccination, and she is as Bolshevik as they come. This is not about politics.

If you have circumstances about the firing, share them. It is unfair to just say some judge's name and provide no info whatsoever about why the clerk was fired. Some judges - some of whom have been around for 20–30 years (e.g. Boggs) - are bound, statistically, to have some terrible clerks who deserve to be fired.

I have heard of a clerk who verbally assaulted his judge and another one who would show up to work drunk. There is no reason these clerks should not be fired - it is not a reflection on their boss.

As the person who started this thread, I hoped people would share unjustified firings. Not ones for legitimate reasons such as refusing to get vaxxed (those working in the judiciary were required to provide proof at some point), verbally assaulting their judge, or showing up drunk. As stated in the original post, I want this thread to be used as important data for future applicants. Some clerkship offices do not share info about this kind of data and I think it is an important consideration to take into account when accepting an offer. Now let's get back on track. :D

Can confirm that the girl who got fired is very Fed Soc, and that I've heard good things about Scudder as a boss even though I disagree with him on most things. Also, Rivera did get vaccinated eventually (if only so she could be in contention to be Chief Judge), and anti-vaxxers do seem to be more common/prominent on the right than the left. To get back on track though, firing a clerk for refusing to get vaccinated is a completely different story than what Clay (for example) does, so I think providing some context for the firings is helpful.

This, really. I am not going to name my judge here despite the judge having let go a clerk who was objectively a terrible employee. The judge bent over backwards to give the clerk every opportunity to succeed and was 10x more tolerant than any private sector employee would have been. Judges who have to let a clerk go under these circumstances don't belong on a "red flag" list the way more demanding judges would.

Agreed. Having been in a situation as a co clerk to a "terrible employee" clerk, I wished my judge would have just fired this person.

Disclaimer I do not have personal knowledge for the following. This is information I have gathered based on rumors. The Boggs firing I believe was a clerk or clerks leaving early one day to purchase a gift for him. Again, do not have personal knowledge of this. I learned this from someone who clerked on Sixth Circuit who had heard this rumor from one of his co-clerks.
what?

idk the dude who posted about Boggs was being coy and no one was responding so i thought i would offer my completely unsubstantiated information. I'm not claiming it is airtight. Maybe the dude got fired for leaving early habitually and this is the way he spun it. Idk.

I feel like I heard this exact rumor about Judge Clay not Boggs (lol). The clerks were getting him a birthday present allegedly.
