That's not really a clerking specific thing though. If you're practice law outside of New York (clerking or not), then you are exempt.

That's not really a clerking specific thing though. If you're practice law outside of New York (clerking or not), then you are exempt.

Isn’t clerking for a federal judge not considered “engaged in the practice of law”? I’m other words, there are no bar admission requirements for clerking. So, I don’t see how clerking in New York would be engaged in the practice of law in New York for the purposes of this requirement.

You do get a pay bump on the government compensation scale for being admitted to the bar though. So bar membership is not irrelevant to clerking.

"Similar prorated requirements apply for newly admitted attorneys, who must complete 1.5 credits of transitional CLE credit, in any combination of categories, for every month during any part of which they practice law in New York during their first two years of admission to the Bar. These credits must be completed by the second anniversary of admission to the New York Bar.

Please note that any attorney who practices law at the beginning of a cycle and also at the end of a cycle is not eligible for a prorated CLE requirement. For example, if an attorney’s reporting cycle runs from August 2002 through August 2004 and the attorney practices law in New York in August 2002, September 2002 and August 2004, the attorney is responsible for all credits for that cycle, not a prorated requirement, since the attorney practiced law in New York at the beginning of the cycle (August 2002) and at the end of the cycle (August 2004)."

so if you graduated in 2021 say, then you were practicing and were admitted prior to the clerkship started and the clerkship lasts one year then you go back to practicing in new york, you are on the hook for all CLE (2*16). if your clerkship is two years, then you are only on the hook for 1.5*(number of months you practiced while admitted prior to clerkship)

OP here, I was admitted in late 2021 and am clerking from 2021-2024 on federal courts outside of New York, so it seems like I am exempt. Thanks again y'all.
