Yeah this is wrong, you need SCOTUS-equivalent credentials, but it’s somewhat more open to candidates from non-feeders and non-HYSC schools than SCOTUS. It also doesn’t care about political affiliation/connections, unlike SCOTUS hiring. This is new. Every past administration had some mix of conservatives and liberals. Not a good look. Not a smart move, either, with the Court's current balance. Last year had a Richardson clerk and this year has a Scudder/Kovner clerk. It’s not like they’re all Fletcher clerks. And it could easily be explained by fewer conservatives applying to the Biden SG’s office, not by bias, especially since the pool of very top candidates skews heavily left in the first place. Prelogar has also hired conservative ASGs which is much more consequential than the Bristow.

It's also likely that it's a result of the 6-3 Court. At least four liberal candidates who would've clerked for the Court pre-2020 are now in the Bristow pool every year, and at least four conservative candidates who might have been interested in the Bristow are out.
