Interesting generational effects. Sutton and Sykes are doing better than ever, but Wilkinson and Tatel are nowhere to be found.

Perhaps some of that can be ascribed to the fact that Wilkinson apparently has not seen his clerks for the last couple of years because of Covid.

Without putting David Lat out of business, a few takeaways/notes of interest:

1. Alito hired a clerk from Scalia Law with a PhD in engineering for this term. I can't remember how many PhDs there have been on the conservative side, but it does seem to be going up.
2. One of Sotomayor's clerks this term is the one who had to leave the clerkship early a year or two back.
3. One of CJR's clerks was originally supposed to clerk for Barrett on the 7th before she was promoted.
4. I do not know for a fact if there is a relation, but it looks like Alito hired a member of the storied Lee family.
5. Barrett has hired one of her old clerks.
6. It appears Katsas has a few clerks listed who already had SCOTUS clerkships before he hired them. His hiring process must be absurd now.

Judges with clerks hired post-2022 term (below), with the list of judges represented in the 2022 term, it becomes quite clear which judges are advocating hard for their clerks to be hired well before they have ever clerked for them. This throws a bit of a wrench into the typical SCOTUS hiring process:

Thapar: 7
Katsas: 5
Oldham: 5
Pryor: 4
Friedrich (D.D.C.): 4
Sri: 3
Newsom: 3
J.R. Walker (D.C. Cir.): 2
Kovner: 2
Engelmayer (S.D.N.Y.): 2
Mitchell (Ala.): 2
Grant: 2
Pacold (N.D. Ill.): 1
Nielson (D. Utah): 1
Rao: 1
Wood: 1
Tjoflat: 1
Matey: 1
Pillard: 1
Boasberg (D.D.C.): 1
Moss (D.D.C.): 1
Barron: 1
J. Smith: 1
Millett: 1
Kethledge: 1
Cabranes: 1
McFadden (D.D.C.): 1
Ambro: 1
Wilkinson: 1
Park: 1
Hardiman: 1
Bush: 1

I imagine KBJ will have some clerks she initially hired for DC Circuit that will be going to her in the coming years.

She didn't hire out a lot, I think on purpose. I think it's more likely to see lots of her DDC clerks coming back.

I believe she hired out for 2022 and 2023, plus one clerk for 2024. So nine in all.

David Lat's new list shows that a generational shift might be on its way, at least among conservatives. Didn't see much of Sutton or Wilkinson although Pryor is still doing very strong with CT. Thapar and Katsas are posting absurd numbers.

I believe Katsas has hired a few people with SCOTUS clerkships already lined up (or a Justice placed them in his chambers in preparation), and Thapar has apparently hired every child of well-connected conservative legal movement members.

Who are the big feeders on CA9 (asking for a moderate liberal who is also comfortable clerking for most Fed Soc judges but not someone like Oldham or Van Dyke).

Fletcher, Watford, Bress, and Collins are probably your best bets.

Wait why is Watford stepping down? I couldn't find anything about this online or on the US Courts' judicial vacancies page, so is this actually true? He's too young/hasn't been on the bench long enough to go senior so this is certainly surprising - especially for someone who was on Obama's shortlist for a SCOTUS vacancy. Did he realize that SCOTUS wasn't in the cards and decided to cash out instead?

Heard another source in the federal judiciary (or maybe a fellow TLS reader) that Watford is retiring

Wow. What happens to their future clerks in this situation? Are they just out of luck?

Usually they get re-placed. I know a future Watford/Feinerman clerk, I’m sure they’ll be find but that’s bad luck lol.

I'm aware of one person who was slated to clerk for Garland, and then... AG. So that person had to scramble to find a replacement, which was Watford. And the Watford clerkship hasn't started yet IIRC. Yikes. (Granted, this person is going to be more than fine in life, but still.)

Reminds me of a friend who was supposed to clerk for Gorsuch in 2017, then got Kavanaugh in 2018 as a back-up gig. It also worked out for him; clerked elsewhere in 2018 and at SCOTUS in 2019.

Probably not unless he keeps it up, he’s been a judge for a long time now and typically doesn’t feed all that much. The growth potential for liberals is also… limited. I’d call him a semi-feeder though.

Seriously? What are you waiting for?
