chances for patent law clerk

Post by Anonymous User » Wed Jun 03, 2020 5:53 pm

Hello i'm a rising 3L, below median at YSH, with a science undergraduate degree, going to a firm with a strong patent lit group that I intend to join. Exec board of secondary journal, moot court.

What are my chances at patent heavy district courts in CDCA, D.Del, texas?

Thank you

Depends a lot on the judge, the term, and how long you work beforehand. Look up which judges are doing/did the Patent Pilot Program, and focus on them/sell yourself as a patent person. Many judges want to see work experience beforehand, and patent lit would be ideal experience for judges like this. Some judges with grade cutoffs/preferences will bend them for YSH applicants, but you should expect some radio silence from certain judges who get many YSH apps every term. Chances increase as your experience increases, but your best shot will probably be clerking 2 years out.

Agree with Decimal. Work experience at a strong patent lit group would be helpful - as would, of course, an recommendation from any former clerks you work with.

If you're ready to apply now, apply - doesn't hurt. But having the work experience and work recs might also be helpful, so don't be afraid to apply again after 6-12 months at the firm.
