When writing a Statement of Facts for a case that deals solely with a procedural issue, what is best to include?
Since it deals with a procedural issue (the lower court didn't follow the proper procedure) the actual circumstances of the situation that brought the parties to court don't matter. The only relevant facts are the procedural history of the case, what went on in the lower court, who filed what, and what the lower court did. And this would look identical to the Statement of the Case.
