When writing a Statement of Facts for a case that deals solely with a procedural issue, what is best to include?
Since it deals with a procedural issue (the lower court didn't follow the proper procedure) the actual circumstances of the situation that brought the parties to court don't matter. The only relevant facts are the procedural history of the case, what went on in the lower court, who filed what, and what the lower court did. And this would look identical to the Statement of the Case.

What's the context for this question? Is it a question at all? You seem to have provided your own answer.

Yeah need more context but when writing something that has very little to do with the underlying facts, I would still provide a sentence to a paragraph on the underlying matter. People wonder if there's just nothing. Sometimes it's enough to just say it's a wrongful termination suit or something like that, but a little more detail might be better, depending on page limits and your audience, etc.
