A manager has booked a coach bus for a two way trip to Malaysia to visit an exhibition. The cost of the trip is $2,500 for 2 way in total. Manager paid a deposit of $500 5 days before departure.
Here is the scenario: There are heavy floods so the coach company suggested driving slowly in order to reach the destination on the eve of exhibition. Manager refused to proceed with the journey on the departure day.
Can the contract be discharged and is the manager entitled to claim his money back or pay up the balance?
My question is: Is it discharged by repuditory? The manager has not performed his obligations. What is the condition? Any insight would be helpful. Please help
