Habeus Corpus paper topic ideas (halp plz)
Hey.
Im trying to find a topic to write about for my Habeus Corpus seminar.
It has to be like 30 pages so there has to be a lot to talk about
Anyone have any ideas?
Low hanging fruit preferred

There are basically no guidelines.kalvano wrote:Pretty broad topic. Like what sort of thing? Criminal appeals?
Class has mostly been about POW/Gitmo stuff, but I'm not really into that.

I found the actual innocence exception interesting. Or the lack thereof.
I did an in-class oral argument on Chaidez last year, that topic wasn't bad either. Maybe try to see if there's anything on the S.Ct docket for this term?

How about the difficulty in bringing a habeas petition for ineffective assistance of counsel? Your defense counsel can sleep during your trial and that's not good enough to warrant a new trial in some states.

This law developed within the last ten years from the states first then to the U.S. Supreme Court but I don't know if you could make it 30 pages:
The effect of failure to adequately advise a defendant of immigration consequences in a guilty plea proceeding. Used to be, "Too bad, it's a collateral consequence." Now, you can get pleas set aside years after discharge from probation or parole meaning that the State must now either try or dismiss the original charges. Of course, the State long ago disposed of the evidence because the case was closed.
