Con Law question

Post by purell2 » Sat Jun 01, 2013 5:08 pm

Hey all-

I'm prepping for the bar and I have a quick constitutional law question: How does the 11th Amendment (sovereign immunity) comport with challenges to the Dormant Commerce Clause or Privileges and Immunities? Specifically, how do out-of-staters bring challenges in federal court against a state for violating the DCC or PI in light of the 11th Amendment?

Thanks...and sorry if this is a stupid question. I haven't looked at con law in quite a while!

By suing a state official for for equitable relief (declaratory judgment or injunction) and not suing the state directly or for money damages.
