2. I ask because I read articles about recent graduates setting up their own firms.

I don't know what the failure rate is for new firms.. but why would you open a new business in an already glutted industry? An industry that is regulated so that you cannot solicit customers directly or go out and hustle for work?

Aren't you in some sort of "limbo" post-bar exam where you need to be sworn in before you can practice (which take 3 months or so after you get your results)?

It depends on the jurisdiction, and sometimes the judicial districts within the jurisdictions. Most courts post their rules online.

I'd be fricken terrified of malpractice, but I see it done - usually very badly.
