On the one hand, I think I do have some advantage in thinking quickly and writing under a time constrained testing environment, so it might not necessarily be best for me to do a take home because I don't always have the ambition to just grind on the same thing for days on end.

On the other, it would at least cut down on the need to study everything.

Yeah I was pumped, I managed to get EVERYTHING (even the minor issues and weak defenses) in there with enough time to proof-read it. Put 27,000 character down. Probably helped that it was a short fact pattern. Some people were leaving halfway through...idiots.

If there is a clause in the contract that allows the offeree to modify the contract at their own will, does this just then become a question of unconscionability? We didn't cover too much on modification, other than the difference in consideration between UCC and common law. Seems like you should just argue both sides in whether the modification was reasonable in light of the circumstances.

Quick Civ Pro question:

In regards to tricky/fraud in Service of Process, the plaintiff needs to 1) inform about the service and 2) provide an opportunity to leave before service is made. (a la May Dept stores)

Though, it seems that courts don't apply this standard, but instead seem to allow trickery unless it is outrageous conduct that shocks the conscience. I am confused on this one, I thought trickery wasn't even a tricky concept.

I can't see this turning out well. Don't know wether I should try and winnow out the issues on this exam and expect them to be on the next exam. Need to figure out my strategy, haha.

If people only have 3 exams PLUS you have multiple days of study time in between each exam, y'all shouldn't be complaining.

This week's exam schedule was Ks on Monday, Torts yesterday and Property tomorrow. I have Crim Law on Monday. Then I also had a ridiculously hard legal writing class graded and then another class.

The only good thing about finals is that it teaches me what I need to do better for next semester.

Can't wait for Monday to be done.

Do most places have only 3 substantive course for first semester 1L? My school does 4 substantive plus a graded writing and a graded legal research (separate courses) for a grand total of 6.

I had a final Monday, Wed and Friday of this week. Then one next week Monday. My school has a graded LRW class and then a non-graded class that was pretty bunk. My LRW class also had a midterm and a citation final. Not sure what others had graded in that class, but ours needed to be rolled in. It was far too much busy work in my eyes. I had a meltdown in November.

I'm keeping my school under locks just to keep my own privacy sanity where I can.
