I'd have all of them in there. You never know if the fact pattern he gives us is more similar to a case from the New Deal Era as opposed to one of the more recent cases. If that happens, you can write something like "the most direct precedent is XYZ from New Deal" but then do an analysis of whether Lopez, NFIB, etc. have changed that.Bronck wrote:Good to know. The most relevant, sure, but I'd say all the post-New Deal cases would still be at least a little relevant. I'm still not 100% sure how I'm going to answer CC questions for my professor, but I think I may just do 2 analysis's, 1 pre-New Deal and 1 post (with separate sections on the pre-Lopez and post Lopez interpretations). My professor has basically gone REALLY in depth on 3 topics so far (commerce clause, various executive powers, and the equal protection clause) and then only spent a small amount of time on other things (like judicial power and the 10th amendment). I feel like we move really slow, so I can't help but think other con law classes are hitting a lot more topics than us (not that I'm complaining).Nelson wrote:I wish I knew WTF was going on with con law. The other guy is tough but I take solace in my belief that no one else in the class knows where he's going most of the time either. If we're all equally confused, then it's a wash.

Yeah, as far as the CC stuff goes, I think the essentials are McCulloch, Gibbons, Carter v. Carter Coal, Jones & Laughlin Steel, Darby, Wickard, Heart of Atlanta, Katzenbach, Morrison, Lopez, Raich, and NFIB.
