I guess a follow up question to this. What are the elements you are hitting in proximate cause? Forseeability, intervening, superseding, and direct cause of the damage? I have struggled in finding a comprehensive way to cover proximate cause without feeling like I am rambling on.Lacepiece23 wrote:depends on your prof probably. For mine he didn't teach damages, and also spent minimal time on duty. Our model answer didn't even mention duty unless it was relevant in the fact pattern. Our prof kinds taught duty breached interfused with duty. So I usally just organize the different duty breach standards under headings.
Like this
Reasonable Person
Custom
Defenses
Proximate Cause
Duty (if relevant)

Re: OFFICIAL 1L Exam Prep & Motivation Thread (CSWS)
Just did my last contracts practice exam that I have from my professor. Man, that time really goes quick lol. Definitely coulda used an extra 15-30 minutes, and I ended up just ignoring a few issues, but I guess thats not a bad thing, since I had good analysis on everything else (I think, anyway haha). Then again, this professor prefers less analysis of more issues than more analysis of less issues, so maybe I need to change my approach a bit. Oh well. I'll do a practice exam from another professor tomorrow and see how it goes...

I dreamt about the terrible essay I wrote for my K's exam yesterday. Ugh.
Time to study for something else and get that out of my mind.

For those of you who are health conscious and need motivation, studying burns between 70-110 calories per hour.
I don't know about you, but I'd rather be studying than on a treadmill.
Although, studying is kind of like being on a metaphorical treadmill.

I was curious why I've been eating so much more lately. I knew studying burned some calories, but I didn't realize that 8 hours of studying burned around 900 calories for a guy...

And you're sure that's just not your basal metabolic rate? I mean, 2000 calories a day on average / 24 hours in a day is 83 calories/hr after all.Doorkeeper wrote:I was curious why I've been eating so much more lately. Re: OFFICIAL 1L Exam Prep & Motivation Thread (CSWS)
I've been wondering. Been chowing down a good 3500 calories a day for last 4 weeks or so, and was expecting to gain a shit load of weight, but if anything, looks like I've been losing a little (I usually gain weight in winter, just because less outdoor sports, and more seditivity on the couch)Doorkeeper wrote:I was curious why I've been eating so much more lately. Been studying 12-16 hours a day the last four weeks or so, and my metabolic intake without any exercise is about 2500 calories for 0 weight gain. (actually did a weight gain study in undergrad to earn money)

I have been outlining for like 7 hours. Hopefully I can get to at least one practice test tomorrow because I haven't done any yet.

CivPro Wed., 2/3 through outlining
Thinking of pulling an all-nighter tonight to finish outlining so I have 2 days to take practice exams. Thoughts?

Don't pull an all-nighter. Go to sleep around 3am and wake-up at 10am, or something to that effect.shumpshump wrote:CivPro Wed., 2/3 through outlining

You don't want to be sleep deprived going into the exam, or while you're taking practice exams.

I agree. 7-8 hours of sleep a night are necessary. Don't make yourself sick right before examsDoorkeeper wrote:Don't pull an all-nighter. Go to sleep around 3am and wake-up at 10am, or something to that effect.shumpshump wrote:CivPro Wed., 2/3 through outlining

My test on Wednesday is at 3pm though so I kinda need to change my sleep schedule slightly. On my regular sleep schedule (where I wake up at 9am), by 7pm (when this test will finish on Wed.) I'm tired as fuck. I don't want that to happen on Wed...Doorkeeper wrote:Don't pull an all-nighter.
