Closed Memo Advice?

When completing a predictive memo, does it matter which side we choose to support? Is it true that you should be able to make both arguments for any claim in a law school class? We aren't allowed to use outside sources for this memo...

Choose the right side. There very well might be a right answer for that.

There shouldn't really be a "choice" so-to-speak, at least with all of the predictive memos I've written. Since you're doing something for school, it may be a more ambiguous issue, so just go with the conclusion that is supported by the law, or have a good reason for going against the law. Make sure that you point out possible counterarguments and possible pitfalls in your conclusion. Your aim with a predictive memo is giving advice to the principal who will make the decision as to how to proceed. That individual needs to have a full, realistic picture of the legal landscape so that he/she can make an informed decision.
