evidence sample exam question?

Post by chocolatevanillacake » Wed May 02, 2012 11:29 pm

Hey, so i have this sample exam question

A and B are charged with conspiracy to sell cocaine. They both give separate confessions to the police that implicate the other. Both are tried jointly, and both do not testify. Truth or False: the prosecution can use at trial the two confessions against both of the defendants.

Is this true or false? The professor's sample answer says "true," but doesn't that contradict Cruz v. NY?

Thanks!!!!
