Are they charged under the criminal code? Are they classified in the criminal code as misdemeanors? Some violations may be criminal, some may not.

Crimes in the NY penal code are defined as misdemeanors and felonies, so a violation is not a "crime". However, a violation hearing is considered a criminal proceeding.

Do you know a specific section or something that says this? I havn't been able to find anything in ny penal code that says a violation is not a crime. the inclusion of offenses that are violations grouped with misdemeanors implies the opposite to me
