Hi Everyone,
I am not a law school student but I am trying to seek some legal advice. I have contacted numerous lawyers and none of them was able to help me out because it is not their specialty.
I am in a pretty difficult situation right now. So what happened is I have been dismissed by my school (Public Institution) due to inconsistent academic performance. However, part of my academic performance was due to a learning disability. I am also diagnosed with major depression since I started the program which also affected my academic performance. I was not provided disability accommodations for the first two years with the school and was struggling academically. However, after the accommodations was put into place, I was doing better. For the past year, I have been doing fairly well and was very on top of things. It was my last year of the program where I was doing rotations (internship) and had a bad evaluation from a preceptor which caused me to fail a 6 unit rotation. I needed to take some courses to improve my GPA so I appealed to have a 6 week extension to the school’s 6 year policy. However, it was denied and I was not given a reason. When I met with a faculty member, they said they denied because I have been inconsistent with my academic performance "wanted me to get my life back together before starting school again"
I would like to seek some legal advice. I have over 100k of student loans from this program and I feel that it is inappropriate to dismiss me at this point. It is my last year and I just need a 6 week extension to finish rotations.
Do I have a case and should I fight with the public school system? I have contacted disability lawyers and none of them deal with learning disability. The lawyers that deal with education law are way too expensive for me at this point. I also contacted lawyers for low income clients but most of them deal with criminal defense or bankruptcy or other civil matters but none of it would come close to my case.
I understand that you may not able to offer me advice but perhaps someone can direct me to somewhere who could? Should I seek an education lawyer or disability lawyer? Thank you very much!
I am open to private messages if we need to discuss things privately.

I didn't even read past this. But that is your first clue to help you answer your own question.
Plus, this forum isn't a place for legal advice.

Yes I understand but I have no other choice. I am desperate for help... No one can help because it doesn't fall into their speciality.

You came here for legal advice? We aren't lawyers so this probably isn't the right place. And if actual practicing lawyers couldn't help you, how in the world could we?

Well hopefully we law students will be more able to help than practicing attorneys.

1) Law students are not allowed to give legal advice and anyone who will give you legal advice online will not be giving you good advice.
2) Call your local Bar Association and ask them to refer you to a pro bono group that can help.

If you haven't already tried again to talk with school officials to have this solved informally, then contact a lawyer. Look around on the Colorado state bar website:
http://www.cobar.org/. There is a lawyer referral section, and you can probably search by specialty to find someone who has knowledge of these kinds of issues.
Edit: list of attorneys in CO who have education law practice (if that is even what you need... I honestly don't know.):

It's not only that we don't want to give you advice- we aren't allowed to. Any halfway decent attorney will talk to you and at least refer you to a lawyer who can help. Good luck.

The thing is, I don't even know what type of case do I have... I just feel that it is so wrong for the school to deny a SIX week extension when I am in my last year of school and it is supposed to be a whole year of internship. They say it is due to inconsistent academic performance but part of that was due to mental illness and learning disability.

If you think you've tried "everything" and won't take any polite suggestions from a group of people who have already informed you that giving you real legal advice would violate ethical rules, you probably could stand to take time off and graduate later.

They are not allowing me to take the time off. They are formally dismissing me from the program. I completed 5 year and I am in my last year where it is a year of rotations (internship). I have over 100K of student loans and invested 5 years of my life into this program. I would have to start from scratch if I want to reapply to another school. The dean of my school was really supportive of me and he believed that I have the didactic knowledge but he could not go against the school's appeals committee.

Your situation is unfortunate, but there is literally nothing any of us can do. Re-read what everyone in here has said. At least a few people here have tried to direct you to where you can try to find an attorney. That is above and beyond what you should expect from a forum like this. Since it is Friday night, you have all weekend to research attorneys online. Make a list and start making calls on Monday.

Thanks! I understand that everything. I just thought I gave it a try. I spent the whole day calling and emailing lawyers. Most of them want a consultation fee that is in the hundreds. I just want to know if I even have the slimiest chance before paying any lawyers.
