Damages question for torts

Post by abenson25 » Mon Dec 13, 2010 12:50 pm

I have an old exam from my professor, and one of the questions deals with damages. We have not got to damages in class. Instead, we had to read the cases on our own and know them for the exam. So I am hoping for some help...

The fact pattern, is among other things for a guy that aids in the burglary of a home. Some of the stolen goods are found in his home. The question goes on to ask: If he is sued for both trespass to chattels and conversion, what concepts and rules regarding damages should be considered in determining (a) whether the plaintiff should be awarded damages and (b) the amount of damages.

the only thing I can think of is that since he stole the jewelry, under conversion, he must either return the goods or be liable for the full value of them. I am sure that there must be more and I am blanking on anything right now...
