Top Law Schools

So, what happens if you fail one class during 1L, but otherwise do fine? Retake during first semester of 2L, next summer, kicked out of school?!

(It's not LRW, just a regular class, 2nd tier school)

I'd say I studied very wrong.. it was Con. Law and I studied more for a general Con. Law exam, and this one was, well... not so normal. There were questions regarding specific justices' opinions on things, not a lot to do with what I prepared for... So to answer your question, no, I just did bad.

Different schools treat someone in your position differently. At my school, you can get permission from a committee to retake the exam from the class you failed. If you get a grade of C or higher when you retake it, your grade becomes a "C." I have a feeling there is a way to move forward without getting kicked out of school. I strongly recommend talking to your Dean of Student Affairs about it. If they ever do kick you out, they might have to hold some kind of hearing to do so, or let you appeal the decision to part of the administration. And, there may be procedures under which a kicked-out student can be readmitted.

In any event, if you stay motivated this will not hold you back in the long-term. I know a talented guy who just graduated, and the nonprofit that hired him didn't even ask to see his transcript. He got great grades, but his new employer has never seen them.

And, like a law school professor said when I went to him for advice, "America is the land of the second chance."

A good place to start is your student handbook. It should list the penalties, if any, for receiving low grades.

But seriously, failing a class must put him way below median. Isn't below median at a T2 a very bad place to be?

At my school, a 3L failed a class (maybe more than one) and he is simply staying an extra semester to get all of his classes in because he had to retake it. I would be incredibly surprised if they kicked you out of school - but I agree with the above, check with your Dean of Students.

He failed a class. He has more serious problems than "way below median."

Thanks for the replies. I don't care where I am in the class as far as rank goes.. My situation is different than most people's (getting paid to go to school by the VA, so why not, it's money I'd never see if I didn't go to school). I'm going to talk to the school tomorrow obviously, just trying to stick around for the rest of law school is all I'm going for here..

I actually agree with dominkay, to some extent. Even if OP can stay in school, would it really be worth being way below median at a T2?

I suppose a lot of it depends on factors like debt, any connections that can get him a job, etc. But it may be that OP would be best served by dropping out.

Depends on what the rest of OP's grades look like. If they are consistent, and are at or above median, then it looks like a serious fluke. It could be attributed to being a 1L. Also, this is less of an issue if OP is seeking a position at a small firm, is planning to strike out solo, or go back in the military (prior service would probably counterbalance). More of an issue if seeking a position at a mid to large size firm, non-military government job, etc.

Also, the result depends entirely on what OP's school does with situations like this. If OP retakes, and the grade is replaced with the higher grade, then obviously, none of our conjecture matters.
