I think the answer to this will vary by firm, but if you think there is a realistic chance it will get noticed and you would get terminated (or even get a note in your personnel file or something), it could then certainly come up in the event you choose government opportunities or the like (more relevant if you are a litigator) so if you can swing it financially and otherwise, it would not be a bad idea to get ahead of it by resigning.
