Unpaid internship show up on background check?

So I'm submitting to a background check., second legal job. After ls I had a terrible unpaid internship that I quit after a month. I took it off LinkedIn and resume. Will it show up on background check? Do I have to list under employment?

You don't have to put every job you've ever had on your resume or linkedin, so unless someone asked you a specific question that you lied about there's no reason that this would be a problem. Doubt it'll show up anyway, but either way you're fine (unless you lied).

The employment app says list last 4 jobs. I'm thinking of not listing it, since it wasn't on my resume and I didn't get paid. I don't know if that's lying

It probably won't show up because it was an unpaid position, but it might depend on who the position was with. For example, if it was for a government position or agency it might show up, but doubtful.
I'm curious who the position was with and why it was so bad.

It was with a toxic small firm that was insane and treated me like crap. I quit angrily.

Uh yeah you should obviously list it if they ask you for all your jobs (or your last 4 jobs) for background check purposes. It would be really stupid to not disclose a law firm job. No, you don't need it on resume/linkedin.

FYI, I was in a similar boat with the Brooklyn DA's Office. Interned there for about 2 weeks, realized I was wasting my time, and quit. Did not include it at my current job (other DA's office) or the bar application. No issues.
