Well probably this. But first you'll get lots of exciting new arguments about the new rules of civil procedure. And then magistrate and district court judges go back to doing what they were going to do anyway.

I've become convinced that idiot technophobe boomers are the only reason discovery sucks so much. There's really no reason for it to suck more than a little.

Or a combination of asshole plaintiffs who want to abuse discovery to drive up costs for defendants (forcing settlement) and asshole defendants who try to bury/destroy important documents.
