not employment-related: course selection

we have to take mandatory con law class in our second or third year. One class was full on the first day of registration. the other - as I found out today - is currently 45% full. Could this be a reflection of the professor's teaching and/ or his popularity?
I know a few people who were in his con law class last semester but don't want to ask, esp. via email or facebook. (given that he only came to our school last year I could not get his evaluations somewhere) what I found strange is that the class that is currently full is scheduled in the early morning.

what do you think? I feel like dropping and taking it in my third year or the second semester of my second year.
