Which one? I'm interested in getting experience to make my resume look better for a potential litigation position in the future. I have already had a state trial court judicial internship. Thanks.

What are your grades and school rank like? If top grades/rank = plus for magistrate judge because you can talk about it during clerkship interviews and try to network while at the court.

Is the division/section/branch of the AG's office one that you would like to practice? If yes = plus for AG office because magistrate will likely be social security, criminal work, prisoner litigation, and maybe some discovery/pretrial/trial civil matters.

Does the AG in your state hire new grads? If yes = plus for AG office. Judges often say they won't hire former interns (and if your grades/rank are not top notch, working for the judge probably won't help with a clerkship app).

Are both in the state you want to practice in? In the city? Location can be an important factor.

In the abstract, I think interning for the judge probably looks better. But I don't think that should really be a major factor in your decision.

Let me start off by saying that I love my internship with a federal magistrate. That being said, if you have already done a state court internship, you have the judge thing on your resume and should get some experience working from a different angle. Go for the State AG's Office. You will get extra experience and it will add something new to your resume.
